Terms of Use

These Terms of Use ("Terms") govern your use of AIFoodTracker ("the App"), developed and operated by PatakoLabs. By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use AIFoodTracker. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.

2. What the App Does

AIFoodTracker helps you log meals, track calories and macronutrients, monitor weight, and photograph food for AI-assisted nutritional estimation. The App uses on-device storage, Apple iCloud for optional sync, and external services for AI food recognition and nutrition data lookup.

3. Not Medical Advice

• AI-generated food identification and nutritional estimates are approximate. They may be inaccurate, incomplete, or wrong.
• Nutritional data from third-party sources (USDA FoodData Central, Open Food Facts) may contain errors or be outdated.
• Weight forecasts are statistical projections based on logged intake and are not predictive of actual health outcomes.
• Do not rely on the App for managing medical conditions, allergies, food intolerances, or any dietary restrictions where accuracy is critical to your health or safety.
• Always consult a qualified healthcare professional before making dietary decisions based on information from this or any food tracking application.

4. Subscriptions and Payments

AIFoodTracker offers optional paid subscriptions for increased daily AI analysis limits:

• Free tier: 10 AI photo analyses per day (no payment required)
• Premium Monthly: 50 analyses per day ($2.99/month)
• Premium Yearly: 50 analyses per day ($19.99/year)

All features other than AI photo analysis — including manual food logging, weight tracking, fasting logs, barcode scanning, charts, and the local food database — are free and unlimited.

Subscriptions are processed exclusively through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions.

PatakoLabs does not process payments directly and has no access to your payment information.

5. Bring Your Own Key (BYOK) Mode

AIFoodTracker allows you to use your own OpenAI API key for unlimited AI food analysis. If you choose this option:

• Your API key is stored locally in the device Keychain. It is not transmitted to PatakoLabs servers.
• Image data is sent directly from your device to the OpenAI API. PatakoLabs does not act as an intermediary in BYOK mode.
• You are responsible for your own API key security, usage, and any charges incurred from the OpenAI API.
• Your use of the OpenAI API is subject to OpenAI's Terms of Use and Privacy Policy.

6. Your Data

Your food logs, weight records, photos, and personal data are yours. They are stored on your device and, if you enable iCloud, in your personal iCloud account. PatakoLabs does not have access to this data.

7. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Attempt to circumvent daily analysis limits or quota enforcement
• Use the App to transmit harmful, illegal, or abusive content through the AI analysis pipeline
• Interfere with the operation of PatakoLabs backend services
• Redistribute, resell, or sublicense the App

8. Intellectual Property

AIFoodTracker, its design, code, branding, and associated content are the property of PatakoLabs and are protected by applicable intellectual property laws. Your use of the App does not grant you any ownership rights in the App or its intellectual property.

Nutritional data sourced from USDA FoodData Central is in the public domain. Data from Open Food Facts is available under the Open Database License (ODbL).

9. Third-Party Services

The App relies on the following third-party services, each governed by their own terms:

• Apple App Store and iCloud — subject to Apple's Terms and Conditions
• OpenAI API — subject to OpenAI's Terms of Use (applies in both BYOK and proxy modes)
• USDA FoodData Central — a public U.S. government service
• Open Food Facts — an open-source community project

PatakoLabs is not responsible for the availability, accuracy, or conduct of these third-party services.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• AIFoodTracker is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or accuracy of nutritional data.
• PatakoLabs is not liable for any health decisions, dietary choices, or adverse outcomes based on information provided by the App.
• PatakoLabs is not liable for data loss resulting from device failure, iCloud issues, or user error.
• In no event shall PatakoLabs' total liability exceed the amount you paid for the App in the twelve months preceding the claim.

11. Termination

You may stop using AIFoodTracker at any time by deleting the App. PatakoLabs may suspend access to backend services (AI analysis proxy, quota management) if you violate these Terms. Termination does not affect data stored on your device or in your iCloud account.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted in the App's release notes. Continued use of AIFoodTracker after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
